3864     RESPONSIBILITY FOR FILING CLAIM
(REVISED 2/93) 

Whoever owns the freight while in transit has the responsibility for filing claims for loss and damage.  Unless the purchase contract states otherwise, the FOB point governs the transfer of title.  Therefore, for goods purchased under "FOB Destination" or "FOB Delivered," the shipper or vendor must file the claim against the carrier for loss or damage.  If the FOB point is other than destination, the receiving agency owns the goods while in transit and must file any claims
